Terms Of Service

1. Parties on Agreement

This agreement is arranged between site's owner and manager Ölçgen Bilişim and member who registered to the site.

2. Definitions

Site: website located at www.telvee.com

Member: the person who filled in the registration form, checked the box next to "I have read the Terms Of Service. I accept all the conditions." and clicked "Register" button to complete the registration process.

3. Subject of Agreement

This agreement defines services offered by the site, terms of use for these services and the rights and the responsibilities of the parties involved. Body of this agreement and all warnings, text, explanations regarding use, membership and services written by Ölçgen Bilişim on the site constitutes the scope of this agreement. Member agrees all annoucements regarding use, membership and services from Ölçgen Bilişim by accepting this agreement. Member declares to act in accordance with the aforementioned announcements.

4. Rights & Responsibilities

4.1. Rights & Responsibilities of Members

Member agrees to comply with this agreement, regulations announced on the site and current legislation during his membership. Member declares that he understands and acknowledges all conditions of this agreement.
Being of the age of majority, not having an account terminated before and choosing a nickname that is both in accordance with general ethics and commercial ethics are required to become a member. Unless all the above conditions are met, even if a membership account is created technically, it will be considered fraudulent and the membership will be terminated reserving all penal and legal rights and Ölçgen Bilişim can not be held responsible for the consequences.
Members declare they understand and agree that the content of the site is posted for the sole purpose of fun, that there are no claims of reading the future, occultism and such, that the content of the site should in no way influence their decisions and that they should not have expectations contrary to above.
Member agrees that Ölçgen Bilişim is legally obligated to disclose personal information of members upon request from legal authorities and under no circumstances reparations regarding this condition can be claimed from Ölçgen Bilişim.
Security, storage, concealing from others' knowledge and usage of means of access (username, password, etc) for services at the site provided by Ölçgen Bilişim, are completely under member's responsibility. Ölçgen Bilişim can not be held responsible for any direct or indirect damages to members and/or third parties due to negligency of these conditions.
Members agree and declare that information and content they enter to their profile and other places in the site are correct and legal. Ölçgen Bilişim is not responsible for validating the content published by members or uploaded, changed and entered during creation or modification of their profiles, does not declare and guarantee that this content is correct, valid and in accordance to this agreement and legislation, nor can it be held responsible for any damages due to incorrect and erroneous information and/or redirections to other Internet sites based on that information.
Members agree and declare not to publish or share sensitive information (such as phone numbers) about themselves and others.
Members have full legal and penal responsibility for each interaction on the site including private messages exchanged with other members. Members can not send advertisements or messages of commercial nature to other members or publish such content on the site. Members can not refer other members to another site. Members can not ask money or make other such requests from other members. Members can not make claims of professional fortunetelling, wizardry, reading the future and such implicitly or explicitly. With this agreement members acknowledge that Ölçgen Bilişim can not be held responsible from any incidents resulting from the actions described in this clause. Accounts of members who exchange or publish such messages can be restricted or terminated.
Members can not transfer fully or in part the rights and responsibilities within the scope of this agreement, their profiles, their account information without the written consent from Ölçgen Bilişim; memberships can not be used by people other than the account owner. Ölçgen Bilişim can not be held responsible directly and/or indirectly for any damages to third parties due to such transfers or unauthorized usage. Memberships that are detected to be made available to others or transfered get terminated without warning.
Member can deactivate his account from accounts section. Ölçgen Bilişim preserves the right to store and keep online, member's profile information and published content. Ölçgen Bilişim can delete records of deactivated accounts at a time of its choosing.
Member agrees and declares to be morally responsible and courteous in the messages he sends to other members and/or publishes. Private messages can be scanned via automatic programs or upon recipient's complaints. Memberships can be restricted or terminated if deemed appropriate as a result of these automatic scans or reviews of complaints.

4.2. Rights & Responsibilities of Ölçgen Bilişim

Ölçgen bilişim preserves the right to change the content and services provided by the site, restrict members' or third parties' access or delete the information, content and member profiles. Ölçgen Bilişim can exercise this right without any announcement or grace period. Members must comply with the editorial requests from Ölçgen Bilişim. Ölçgen Bilişim can make these changes itself if deemed necessary. Members have legal and penal responsibilities for not complying with these changes in time.
Ölçgen Bilişim can not be held responsible for files and content or services or products offered by portals and web sites that are accessed through redirections on the site (links, banners).
Ölçgen Bilişim can use member information, member profiles and content uploaded by members for security, complying with law and statistical analysis as it sees fit; these information can be classified and stored in a database.
Ölçgen Bilişim can remove any message or content that is derogatory to site's operation, general conditions, immoral or unacceptable by Ölçgen Bilişim; Ölçgen Bilişim can terminate the membership of the author of such messages and content without warning.
There might be downtime due to technical problems. Ölçgen Bilişim can not be held responsible for problems members might experience due to interruptions to communication and site access.
Any image, text, photo and other content published on the site or in member profiles can not be used in other web sites and conventional media such as newspapers, televisions, radios, magazines without the permission of Ölçgen Bilişim. All content published on the site is under protection of the seventh subclause of the fourth clause of Opinion and Works of Art Law also content that qualifies as work of art are under legal protection.

5. Other Conditions

5.1. Intellectual Property Rights

All elements of the site (design, text, image, HTML code and other content) are copyrighted to Ölçgen Bilişim and/or licensed to Ölçgen Bilişim by third parties. Members can not reproduce, distribute or create derivatives from content that is intellectual property of Ölçgen Bilişim. Members can not sell, share, distribute, publish the services and the content on the site that is Ölçgen Bilişim's intellectual property or allow others to access Ölçgen Bilişim's services through their account, failure to do so will make them responsible to compensate for the damages of Ölçgen Bilişim and license owners including third parties and legal expenses.
All rights for services and content on the site, intellectual propery of Ölçgen Bilişim, trademarks of Ölçgen Bilişim, appereance of the site and rights regarding to know-how are reserved.

5.2. Modifications To This Agreement

Ölçgen Bilişim can modify this agreement one-sidedly by announcing the modifications on the site at an appropriate time. Modified conditions of this agreement will take effect on the day of their announcement, other conditions will stay in effect as they are. This agreement can not be changed with one-sided declarations of members.

5.3. Forces Majeures

In a legal force majeure, Ölçgen Bilişim can not be held responsible for not performing, performing inadequately or performing with a delay, actions defined with this agreement. Such situations will not be considered delayed performance, inadequate performance or not performing for Ölçgen Bilişim and reperations can not be claimed from Ölçgen Bilişim. The term force majeure will be interpreted as natural disasters, insurgencies, war, strikes, communication problems, infrastructure and Internet problems, electric shortages, bad weather conditions and such similar occurences that are not under the control of related parties and inevitable even though Ölçgen Bilişim had done everything it could do.

5.4. Correspondence Addresses

E-mails indicated by parties on agreement are considered to be valid correspondence addresses and notifications to these addresses will be considered valid correspondences. Members agree that these correspondences can not be declared void.

5.5. Standing Law and Authority

This agreement takes effect on member's reading and confirmation. Turkish Laws and Regulations will apply in application, interpretation and arrangement of judicial relations regarding this agreement. İstanbul Courts are authorized to rule for disputes regarding this agreement.

5.6. Revocation of this Agreement

This agreement will be in effect until the membership of the member is terminated, cease effect if the membership is temporarily or permanently suspended.

Ölçgen Bilişim can revoke this agreement one-sidedly for members who does not comply with the conditions of this agreement and conditions regarding use, membership and services published on the site and members will be accountable for the damages to Ölçgen Bilişim due to revocation.
